Which Fee Schedule Applies?

Workers’ Compensation Court Fee Schedules


Notice regarding the Schedule of Fees for Medical Services:

The Nebraska Workers’ Compensation Court is tasked with establishing and adopting a Schedule of Fees for Medical Services pursuant to Neb. Rev. Stat. § 48-120(1)(b). Such schedule will be offered for approval and adoption at the January 26, 2022 Public Hearing and Public Meeting of the court.

The Schedule of Fees for Medical Services is established using the methodology provided in Rule 26, B, which methodology is devised using the Medicare Resource-Based Relative Value Scale applicable to Nebraska.

The 2022 Medicare Resource-Based Relative Value Scale, which was released on December 17, 2021, can be found on the Centers for Medicare & Medicaid Services (CMS) website (

Note that a majority of the court’s schedule is based on CMS data contained in this link, yet not all CMS data is applicable to the court’s Schedule of Fees for Medical Services. Rule 26, B,2,d allows the court to determine the remaining gap-filled CPT codes not addressed by CMS.

The Schedule of Fees for Medical Services also includes certain service categories identified in Rule 26, B,2,e. The conversion factors for these specific services and related CPT codes shall be determined using the Medicare Economic Index (MEI), which is 2.1 percent.
